Japan Passes Groundbreaking Revisions to Sex Crimes Laws, Strengthening Protection for Children and Survivors
In a significant development, Japan’s national legislature has approved groundbreaking revisions to its sex crime laws. The House of Councillors, the upper house of Japan’s National Diet, voted in favor of amendments to Chapter 22 of the Penal Code, which addresses offenses related to obscenity, forcible sexual intercourse, and bigamy. These revisions entail key changes, including raising the age of consent from thirteen to sixteen and updating the definition of rape from “forcible sexual intercourse” to “non-consensual sexual intercourse.”
Previously, Japan’s definition of rape was narrowly confined to instances involving coercion through “assault or intimidation.” However, the expanded definition will now encompass coercion through the “use of economic or social status” as well. These modifications aim to strengthen protections for individuals, particularly children, and make Japan’s sex crimes laws more survivor-oriented.
Human Rights Watch (HRW) has welcomed these changes, asserting that they will contribute to safeguarding the rights of children and enhancing the overall approach to addressing sex crimes in Japan. HRW views these amendments as an initial step toward the improvement of the country’s sex industry.
Despite the illegality of prostitution under the 1956 Prostitution Prevention Law, certain aspects of Japanese culture continue to exhibit the sexualization of young women.
