Texas AG Takes Legal Action Against Chaturbate and xHamster Over Age-Verification
In a significant move, Texas Attorney General Ken Paxton has initiated lawsuits against two prominent adult content providers, MultiMedia LLC and Hammy Media, for their failure to comply with the state’s new age-verification law, HB 1181. The law, aimed at protecting minors from accessing adult content, mandates that websites operating within the adult industry implement robust age verification processes to ensure users are 18 years of age or older.

The legal action targets the operators of well-known websites Chaturbate and xHamster, marking a continued effort by the state of Texas to enforce stringent age-verification requirements. This development follows closely on the heels of Pornhub’s decision to restrict access to its site for Texas users, a direct response to the same legislation.
HB 1181, signed into law by Governor Greg Abbott and set to be enforced starting September, has sparked significant controversy and legal battles, including a lawsuit filed by Pornhub and other organizations challenging the constitutionality of the law. However, recent rulings by the U.S. Court of Appeals for the Fifth Circuit have upheld the age verification requirement, affirming its alignment with the government’s interest in preventing minors’ access to pornography without infringing on First Amendment rights.
While the court has supported the age verification mandate, it halted the enforcement of another provision of HB 1181 requiring adult websites to post health warnings regarding the potential effects of pornography on mental health, citing concerns over compelled speech.
The ongoing legal disputes and the enforcement of HB 1181 highlight the complexities of regulating adult content online while balancing the rights of adults to access protected speech. The lawsuits against MultiMedia LLC and Hammy Media seek damages totaling millions, underscoring the significant implications for adult websites failing to comply with the new Texas law.
