Maine Takes Bold Step: Shields Sex Workers, Clamps Down on Buyers

On Monday, Maine’s Governor, Janet Mills, approved a law that changes the legal stance on sex work in the state. The groundbreaking law removes criminal penalties for sex workers, but continues to prosecute those who buy these services.

The legislation aims to shield and support individuals involved in sex work, without endorsing activities that could grow the trade, such as pimping. Rep. Lois Galgay Reckitt, one of the key supporters, emphasized that it was high time to adopt this kind of protective measure.

Additionally, the law takes a stricter stance against child exploitation. It raises the punishment for soliciting a minor for commercial sexual purposes and introduces the term “sexual exploitation” for the paid solicitation of minors and individuals with mental disabilities.

Many consider this law an essential move in safeguarding sex workers, and they refer to the positive outcomes of similar laws in Canada, Ireland, Sweden, and France. These laws have proven to diminish the demand for sex trade and curb sexual exploitation.

On the other hand, some sex workers and advocates have raised concerns. They criticize the law for not fully decriminalizing sex work and argue that by keeping the buying of services illegal, it still poses risks to sex workers. There’s also concern that the law does not distinguish between sex trafficking and consensual sex work, potentially harming sex workers’ livelihoods.

The law will be enacted 90 days after the legislative session closes.

Alongside these practical explanations, the update highlights a key principle behind moderation: context matters. We review the whole situation rather than isolated words, objects, or moments in a broadcast. A single unverified report does not trigger enforcement on its own.
