On Friday, the 9th Circuit Court of Appeals breathed new life into a lawsuit against Meta, formerly known as Facebook, which claims that Meta’s ad-targeting tools broke anti-discrimination laws.
The court disagreed with Meta’s stance that they were shielded by Section 230 of the Communications Decency Act, which generally protects online companies from being sued for content posted by others.
The judges said that if what the users claim is true, Meta might have played a significant part in developing the ads, rather than just being a place where they were shown.
This class-action lawsuit, spearheaded by New Yorker Rosemarie Vargas and fellow Meta users back in 2019, claims that Meta’s ad-targeting system allowed advertisers to unfairly hide housing ads from users based on characteristics like race, gender, and age.
Though Meta had made changes to its ad-targeting options, the plaintiffs claim the old system was in violation of civil rights laws.
Initially, in 2021, a lower court had dismissed the case. However, the appellate court found the claims specific enough to warrant more investigation and ruled that Section 230 didn’t give Meta a free pass in this case.
The court likened Meta to Roommates.com, which had a similar case in 2008, where Roommates.com was not protected by Section 230 since they provided tools enabling discrimination.
