xHamster Must Comply to Avoid Further Consequences

A judge in the Netherlands has mandated that within three weeks, the adult website xHamster must audit all its amateur content for documentation of consent. If the company is unable to provide proof that the performers in the videos have consented to appear on the site, they will incur heavy fines of up to $32,000 per day.

The ruling applies to those living in the Netherlands, as well as those from other countries who have videos featured on the website. This is due to a decision by the Netherlands-based Expertise Bureau for Online Child Abuse (EOKM) which identified ten videos that did not have adequate documentation.

xHamster had already established a verification process for users who want to upload videos, including presenting legal identification, such as a driver’s license, and a consent form from everyone featured. These measures were put in place in 2021 after Mastercard announced that it would require “clear, unambiguous, and documented consent” from all adult sites.

However, the court has ruled that the website must start getting paperwork from uploaders, even if the videos were posted before the ruling. The decision has had a chilling effect on the ability of content creators and platforms to make a living and remain online. Not only do porn sites face criticism from lawmakers, but financial institutions also discriminate against them when it comes to identity and verification.

In addition, states such as Arkansas are starting to require those in the state to provide a “digitized identification card” in order to view porn, and other states are following suit. This emphasizes the need for xHamster to comply with the court’s ruling in order to avoid any further consequences.
