In a bold legal move, PornHub, Stripchat, and Xvideos are suing the European Union (EU), challenging the stringent criteria and obligations imposed by the Digital Services Act (DSA). At the heart of the dispute is the classification of these adult sites as very large online platforms (VLOPs). This designation brings heavy regulatory burdens, including rigorous content moderation and transparency in advertising. This lawsuit highlights a pivotal moment in the ongoing tension between digital platform operations and regulatory efforts to safeguard online spaces.

Breton emphasized that by “pointing out the responsibility of platforms,” they signal how “things have changed in Europe.”


Three of the internet’s most visited adult sites have initiated legal proceedings against the European Union, contesting the enforcement of the Digital Services Act (DSA) against them. The DSA, a comprehensive regulatory framework, seeks to ensure a safer digital environment by defining clear responsibilities for digital service providers, especially those identified as posing systemic risks to society due to their large user bases. Platforms with over 45 million monthly users in the EU must adopt a higher level of accountability, including enhanced content moderation practices and increased transparency regarding online advertisements.

The contention arises over the European Commission’s classification of these websites as VLOPs, which subjects them to the DSA’s more demanding regulatory regime. The adult sites argue that the Commission’s user count exceeds actual figures and that the DSA’s advertising transparency requirements are excessively burdensome. The legal challenge is not just a disagreement over numbers but a fundamental dispute over privacy, freedom of expression, and the extent of regulatory oversight over digital platforms.

Aylo, the parent company of Pornhub, asserts that the Commission’s determination of their user base is flawed, claiming their actual monthly active users in the EU fall below the DSA’s threshold. This challenge extends to the DSA’s demand for public access to an advertising repository, which would disclose details of all advertisements posted on the platform in the past year. The adult sites argue that this requirement infringes on their operational privacy and the confidentiality of their advertising strategies.

This lawsuit marks a critical juncture in the broader dialogue on digital regulation, privacy, and the balance between safeguarding the public from harmful content and respecting the operational freedoms of online platforms. The outcome of this legal battle could set a precedent for how digital services are regulated in the EU, influencing not only the adult entertainment industry but all sectors operating within the digital domain.
