IT Solutions Combat Cannabis Dispensary Fraud

The legalization of cannabis for recreational use in 23 states has marked a significant shift from its previous stigmatized status to a regulated industry. Despite federal laws that still deem cannabis possession and distribution a felony, state-level legalization necessitates effective regulatory measures to prevent misuse and maintain industry integrity.

Dispensaries are bound by four key principles to operate within the law. Firstly, medical cannabis requires patient verification through state registration and healthcare provider recommendations. Secondly, age restrictions are in place, generally requiring consumers to be over 21 for recreational and possess medical recommendations for medicinal use. Thirdly, businesses must secure appropriate licensing and remain compliant with strict regulations, including age verification and purchasing limits. Lastly, purchasing limits are set to prevent overconsumption and illegal market diversion.

Despite these regulations, dispensaries confront the persistent issue of fake IDs, which facilitate identity fraud and abuse of reward programs. The practice of “looping” poses a significant threat, where individuals exploit regulatory gaps to surpass purchase restrictions and manipulate loyalty programs. This malpractice can manifest as “daily max” looping, with consumers purchasing more than the daily limit by visiting several dispensaries, or “loyalty looping,” where repeated purchases garner unearned rewards.

Identity verification technology (IDV) is an essential response to these challenges. Some states now mandate IDV, which serves as a legal defense, protecting retailers from liability. This technology enables real-time monitoring across different outlets, flagging repeated purchases and effectively closing loopholes exploited by fraudulent customers.

IDV counters looping by enabling real-time tracking across dispensaries, authenticating IDs to prevent unauthorized purchases, and maintaining loyalty program integrity. Furthermore, it provides a digital record and data analytics to help minimize fraud and prove regulatory compliance.
However, IDV systems aren’t without limitations. The fast-evolving nature of cannabis regulations necessitates adaptable IDV systems. Occasional false positives or negatives can occur, and businesses must balance strict verification against customer service. Moreover, smaller dispensaries might struggle with the costs of implementing such systems.

Despite these challenges, identity verification stands as a proactive approach to compliance, thwarting fraudulent tactics, preventing underage sales, and upholding the cannabis industry’s credibility.
